For the second time in two years, a San Francisco prosecution witness who strayed from witness protection has been killed in the city, authorities said Wednesday.Justin Lee, 40, was chased down and slain Monday night in the Mission District, the very day he left a safe house in another part of the state and returned to San Francisco.
Prosecutors said Lee had taken the stand last year and identified Sean "Smiley" Robinson, 39, as the man who had shot him multiple times on 24th and Vermont streets on Potrero Hill on May 26, 2005.
In June, Lee testified at the preliminary hearing against Robinson. He testified that he believed Robinson attacked him to silence him for what he may have known about a homicide in which Robinson was suspected.
