The ACLU has gotten hold of a secret government document and the FBI wants it back. But the ACLU is fighting that order - accusing the government of misusing its power.
All we know about this secret document is that it's dated December 20, 2005, it's three and half pages long, and someone gave it to the ACLU in October. Beyond that, we have only the ACLU's characterization of the document as "mildly embarrassing" to the government, and the ACLU's assertion that its secret designation appears to be a typical example of over classification.
This grand jury subpoena orders the ACLU to return any and all copies of a secret "information paper" dated December last year. The ACLU has asked a judge to deny that order.
